eSocial fines: do you know what precautions to take to ensure your company is not punished by them?
First of all, it is important to understand that eSocial, on its own, does not result in penalties because it does not change the legislation. The obligation to adopt it, however, increases its risks, as it makes the laws enforced more quickly than before.
In other words, eSocial makes the inspection process easier, since all labor, social security and tax information is stored in a single location: the National Virtual Environment. With this in mind, we will ios database below seven fines resulting from failure to provide information. Don't miss this reading under any circumstances!
1. Contract changes and data registrations
We will start with changes to the contract and employee data records. Generally speaking, these must be correct and always up to date — otherwise, you will receive a fine of R$600 per employee!
2. Work accidents
If one of your employees suffers an accident at work, you must issue a Work Accident Report (CAT). In eSocial, the deadline for sending this report is a maximum of 24 hours after the incident. In the event of death, the report must be made immediately.
Fines for late (or missing) information are based on the contribution salary, and repeat offenders will have the amounts doubled.
3. Unreported admissions
Before the implementation of eSocial, organizations had until the 7th day of the following month to report hiring. Thus, the information was sent to the tax authorities through the General Registry of Employed and Unemployed Persons (CAGED).
Now, however, they must be sent by the system within a maximum of one day before the employee begins his/her activities at the company. If HR does not respect this condition, the company will have to pay fines ranging from R$3,000 to R$6,000 — and will also have to pay an additional R$800 for each unregistered employee.
4. Payroll
Failure to comply with the rules regarding employee payroll will result in fines starting at R$1,812.87. And the new parameters must be respected, including the required information and deadlines. Therefore, to avoid fines in eSocial, the ideal is to automate these processes.
5. FGTS
The FGTS is also part of eSocial. Therefore, if the deposit is not made, the remuneration installments are not computed or the deadlines are not met, fines will be incurred.
The amounts may vary according to the type and size of the company, starting at R$10.64 and ending at R$106.41 per employee. And here, too, double the amount will be charged in cases of repeat offenses.
